GENERAL CONDITIONS FOR THE CARRIAGE OF PASSENGERS, THEIR LUGGAGE AND ACCOMPANIED VEHICLES




GENERAL CONDITIONS – Passengers

This ticket is issued by the carrier, A.s.c. ltd (hereafter called the carrier) Incorporated in Malta, Registered Office: Old Bakery Streer La Valletta. Carriage of passengers and their accompanied luggage, vehicles and domestic animals kept as pets is subject to the Carrier’s Conditions of Travel of Passengers and Passengers Accompanied Property, copies of which are available on application to any of the Carrier’s offices. The said Conditions incorporate, in respect of any carriage by sea, the 1974 Athens Convention as amended by Protocol dated at London on 19th November 1976, relating to the Carriage of Passengers and their Luggage by Sea, which in most cases limits the Carrier’s liability for death of or a personal injury to a passenger and/or for loss of our damage to luggage (including a vehicle) and makes special provision for valuables. The Carrier or Master may (nothwithstanding any booking made) refuse to carry any passenger or luggage of any sailing for any cause relating to the safety, comfort or convenience of any other passenger. In such circumstances that passenger shall not be entitled to any compensation or payment whatsoever save that the Carrier shall refund to the passenger any fare or other charges paid to the Carrier in respect of that sailing. It shall be a condition of the contract of travel entered into between the Carrier and the Passenger, that the Passenger has the required immigration documentation necessary for entry into the Country of destination. Prior to boarding, the Carrier (or his agent) shall be entitled to check that all passengers have in their possession valid documentation to comply with the immigration laws of the country of destination. The Carrier may (notwithstanding any booking previously made) refuse to carry any passenger who fails to produce satisfactory documentation when requested. In such circumstances, the Carrier shall be entitled to deduct a cancellation fee prior to refunding to the passenger any fares paid. The passenger shall not be entitled to any other compensation from the Carrier where permission to travel has been refused. The Carrier shall be entitled to re-claim from the passenger all fines or other costs levied on it by reason of the passenger’s failure to produce immigratin documentation satisfactory to the relevant authorities upon reaching the port of destination. In addition any passenger who for any reason refuses to desembark or is refused entry to the relevant country at the port of destination shall be required to reimburse the Carrier for any costs incurred by the Carrier as a result of such action.

GENERAL CONDITIONS – Schedules

All departures and schedules are subject to cancellation or variation without notice. Each Passenger should always check the time of departure at least 12 hrs before. Carrier will not be responsible for any sudden change of schedule/itinerary caused by force major, weather conditions or technical reasons. The Captain and the Company do not accept responsibility for route changes, cancellation of departures or delays in departure or arrival, neither connections with corresponding arrivals or departures of vessels or trains, neither quarantine with sanitary and food charges and others – in this case – at the charge of the passenger. The Captain and the Company do not accept responsibility for a delay in executing the transport contact, neither non-executing, from any consequence that could result in damages, unemployment, war or civil war, total or partial strikes, owner’s unions, workers, officers, sailors, any other staff, whether or not they are employed by the Company, whether laying up or partial or total cancellation of the Company’s vessels resulting from a general or partial lock-out, no matter who are the originators: as a result the Company declines any responsibility for the consequences in delays or interruptions or cancellations of its service and the costs and risks of the stay will be at the charge of the passengers. The Company reserves the right to substitute any of its advertised vessels with another one. The rate will be that of the vessel put into service whether it is superior or inferior of the original rate, the passenger must pay the supplement or obtain a refund of the difference in rates.

GENERAL CONDITIONS – Boarding

Passengers must always check in at the point of embarkation in the maritime stations, not less than two hours prior to the advertised sailing time (we suggest 3 hours in high season). Bookings for person under 18, unaccompanied by an adult, will not be accepted. Passengers must show personal documents af all passengers and document of their vehicles, if any.

GENERAL CONDITIONS – Bookings, tickets and fees

Ticket or booking is always nominative. The possessor of a ticket of the Company or the passenger on board the vessel agrees and accepts that the transportation will be subject to the following conditions of the Company and the terms on the tickets. Open date tickets are valid for 1 year only. Holders should make the necessary reservations well in advance, especially during high season. The Company accepts no liability for the embarkation or transfer of passengers and/or vehicles possessing an open date ticket. No refund will be given on an open date ticket. Port fees and duties are not included in the passengers and vehicles fares, but must be regulated separately. They must be paid when purchasing ticket or, if not, they will be charged in the port of embarkation. The booking of “Deck” accomodations is allowed only when all other fixed accomodations (cabins and numbered seats) are over. Daily trips are excluded. Meals are not included in the price of the ticket but can be purchased from the ship’s restaurant or snack-bars. Moreover the fares can be increased without any previous notice in the case that there is increase on the price of petroleum or there is substantial change in currency. Carrier does not issue free tickets to passengers who report the loss or theft of their ticket. They must purchase a new ticket after payment and refund of lost ticket will be made by issuing agent at the end of the year and only after it has been ascertained that the lost ticket has not been used.

GENERAL CONDITIONS – Refunds

In case of cancellation, passengers can have the right to ticket refund. The following penalties shall be applied: • 30% for trips canceled up to the day preceding the departure; • 50% for trips canceled the same day of ship departure. In any case, the refund right becomes prescribed after three months from the departure date. Passengers, who cancel after departure and those who fail to embark without any advanced notice, are not entitled to any refund. Ticket refunds are effected only in the country and in the office were issued from.

GENERAL CONDITIONS – Liability

The carrier’s liability begins at the moment of departure of the vessel and ends with the arrival in the port of destination. For any damage inflicted to passengers or vehicles, whther aboard, or during embarkation or disembarkation, as well as loss or damage to passenger baggage, Company responsibility can only be effected when passengers or their eligible parties fall into the conditions and limits stated in the law of the Ship-flag and its applications, registering the responsibility of the maritime transporter.

GENERAL CONDITIONS – Luggages

A baggage allowances of 40 kgs for each adult and 25 kgs per child are allowed for all classes. Excess baggage is charged extra at the Company rates. Baggage unreclaimed on arrival at the vessel will stay in the port at the cost and any possible loss to the owners. Passengers must clearly mark their name and destination on each item. Passengers only have the right to carry personal baggage and not merchandise, if not declared in a regualar bill of loading/contract of transport of goods. Any passenger who has embarked or placed in his baggage inflammable materials, explosives or dangerous materials, such as matches, gun powder, cartridges, films, fireworks, etc..or object whose importation is prohibited, or not within the customs and police laws and conditions, will be responsible in relation to the Company or any other transporter for damages and costs that could result from their embarkationwithout prejudice with penalties indicated in the International laws. The Company declines all responsibility regaridng baggage or objects left by passengers, including monies, vochers, jewellery and other precious objects, if they have not been declared and taxed according to their value during their declaration to the Purser aboard. No claim for delays in delivering baggage or goods will be accepted. The Company reserves the right to load baggage on the vessel reserved or on one of the two following without the permission of passengers.

GENERAL CONDITIONS – Vehicles

During the passage vehicles must be locked, the handbreak applied and first or lock gear engaged. Access to vehicles is not permitted during the passage. A reasonable amount of petrol may remain in the tanks during the passage but tanks must not be filled to capacity. The flow from the tank to carburettor must be shut off where this is not automatic. Fuel in cans or other containers is not permitted. On disembarkation vehicle engines must not be started until instructed. Passengers are responsible for driving vehicles onto and from the vessel. The Carrier reserves the right (at the risk and expense of the passenger) to move vehicles at any time and by any means which it considers necessary. Vehicles with luggage loaded on the roof in excess of six feet (approx 1.80 metres) from ground level or protruding beyond the lenght of the vehicle are subject to availability of space carried only by special arrangement with the Carrier and at such additional charge as may from time to time be determined by the Carrier. The Carrier reserves the right (at the risk and expense of the passenger) to remove any such luggage loaded on the roof of a vehicle at any time and by any means which it considers necessary. Passengers accompanied by a vehicle must check in at the point of embarkation not less than two hour prior to the advertised sailing time (three hours in high season), providing documents of car. Standard Vehicles fares exclude certain Vehicles which may be subject to Freight Rates (Camion, Lorries, Trailers, CargoVans etc.) Passengers are advised to arrange insurance in respect of their luggage and other property (including vehicles). Insurance may be effected through the Carrier – details available on application to any office of the Carrier or its agents.

GENERAL CONDITIONS – Accompanying animals – pets

Transport of accompanying dogs and cats is possible. Dogs must wear the muzzle and during the trip shall be lodged in the on board dog house. Small sized dogs are allowed in the cabin, with Captain approval. Cats must be housed by the owner in small cages or baskets. Animals care and maintenance during transport are at the owner charge and risk. The following documentation is required for the animal travelling with you: • for all lines: a veterinary certificate stating that the animal is not sick.

GENERAL CONDITIONS – Law an Jurisdiction

Any dispute between the Passenger and the Carrier shall be brought before the Maltaise Courts and shall be determined in accordance with the international laws (the “Athens Convention” signed at Athens in 1974 as modified by the Protocol signed at London on 19th November 1976).
